In order to clarify the new provisions of the legislation on communications, which entered into force on May 1, 2014, Roskomnadzor plans to implement a set of preventive and explanatory measures, including with the use of the media in all federal districts.

Official clarifications in connection with the entry into force of the Federal Law of 23.07. 2013 No. 229-FZ "On Amendments to the Federal Law" On Communications ":

We inform you that on May 1, 2014, the Federal Law of July 23, 2013 No. 229-FZ "On Amendments to the Federal Law" On Communications "came into force, in accordance with which the following changes were made:

1) Article 2 is supplemented with subparagraph 34.1 of the following content:

"34.1) content services are a type of communication services that are technologically inextricably linked with mobile radiotelephone services and are aimed at increasing their consumer value (including services for providing subscribers with the opportunity to receive reference, entertainment and ( or) other additionally paid information, to participate in voting, games, contests and similar events) and the cost of the provision of which is paid by the subscriber to the telecom operator with whom the subscriber has concluded an agreement on the provision of telecom services; ";

2) Article 44 is supplemented with clause 5 as follows:

"5. If the telecom operator attracts other persons to provide content services, with the exception of telecom services provided through a single portal of state and municipal services, the telecom operator, based on the subscriber's request, is obliged to create a separate personal account intended only to pay for these communication services within the funds available on the specified personal account. In the absence of this appeal, payment for these communication services is carried out in the manner prescribed by paragraph three of this paragraph.

The provision of other services, technologically inextricably linked with the services of mobile radiotelephone communication and aimed at increasing their consumer value, is carried out with the consent of the subscriber, expressed through the performance of actions that uniquely identify the subscriber and allow to reliably establish his will to receive these services.

Prior to obtaining the subscriber's consent to provide other communication services that are technologically inextricably linked with mobile radiotelephone services and aimed at increasing their consumer value, including content services, the telecom operator must provide the subscriber with information on tariffs for services and a summary of these services, as well as about the person providing a specific service and the personal account from which funds are debited to pay for such services.

Payments for the services rendered to the subscriber are made by the telecom operator. ";

3) Article 54 is supplemented with clause 5 as follows:

"5. Other communication services that are technologically inextricably linked with mobile radiotelephone communication services and aimed at increasing their consumer value, including content services rendered in violation of the requirements established by this Federal Law, are not subject to payment. ";

4) Article 68 is supplemented with clause 8 as follows:

"eight. Communication operators are liable to subscribers for violation of the requirements established by paragraph 5 of Article 44 of this Federal Law when connecting and providing other communication services that are technologically inextricably linked with mobile radiotelephone services and aimed at increasing their consumer value, including content services. "

It is possible to open a content account in MTS only in communication salons, if you have a passport. Upon successful processing of the application, the subscriber will receive an SMS-message about activation of a separate account with the following text: “A separate personal account for number + 79XXXXXXXXXX has been successfully created, virtual phone number + 71XXXXXXXXX. Use it to top up funds and request a balance. " Application processing time is 10 days from the date of application submission.

You can apply to open a content personal account at any Tele2 subscriber service center. For this operation, the owner of the SIM card must have a passport with him. An additional account is opened within 10 days, about which the subscriber is notified via SMS.

After this period, the subscriber's expenses for basic communication services (calls, SMS, Internet) will be debited from the main personal account, and content costs - from the content personal account.

In addition to going to the salon, the subscriber can activate the service on his own, using the USSD command *160# ... Note that all operations for opening, closing, managing a content personal account are free.

When requesting a new content service, a Tele2 user receives an SMS with the name of the option, its cost, and the name of the content provider that provides it.
